1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and United Fall Protection ("Company," "we," "us," or "our") regarding your use of the United Fall Protection Dashboard (the "Service"). The Service provides a web-based platform for scheduling fall protection equipment inspection and cleaning services.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users of the Service, including without limitation users who are browsers, customers, merchants, and/or contributors of content.

2. Account Registration and Eligibility

2.1 Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account

2.2 Account Security

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to:

• Use a strong, unique password
• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with any third party
• Log out of your account when using shared devices

2.3 Account Verification

You must verify your email address before your account becomes fully active. We reserve the right to suspend or terminate accounts that are not verified within a reasonable time period.

3. Use of the Service

3.1 Permitted Use

You may use the Service solely for lawful purposes and in accordance with these Terms. You agree to use the Service to:

• Schedule legitimate fall protection equipment inspection and cleaning services
• Manage your service appointments and account information
• Access service history and receipts
• Communicate with our service team regarding scheduled services

3.2 Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws or regulations
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Transmit any viruses, malware, or other harmful code
• Reverse engineer, decompile, or disassemble any portion of the Service
• Use the Service to compete with us or to build a similar service
• Harass, abuse, or harm other users or our employees
• Violate any applicable local, state, national, or international law

4. Service Scheduling and Payment Terms

4.1 Service Scheduling

When scheduling services through the dashboard:

• You must provide accurate information about equipment types, quantities, and service requirements
• Service availability is subject to time slot availability and our operational capacity
• We reserve the right to refuse or cancel service requests at our discretion
• Service appointments are confirmed only after payment authorization is received
• You are responsible for ensuring equipment is accessible at the scheduled time and location

4.2 Payment Terms

Payment for services is processed through Stripe, a secure third-party payment processor:

• Payment is required at the time of service scheduling
• Payment authorization occurs immediately; actual charge capture occurs upon service completion
• All prices are displayed in USD and include applicable taxes
• We reserve the right to change pricing at any time, but changes will not affect already scheduled services
• Refunds are subject to our cancellation policy (see Section 5)
• You agree to provide valid payment information and authorize us to charge your payment method

4.3 Waiver Requirement

Before services can be performed, you must sign an electronic waiver through our Verdocs integration. Services will not proceed until a valid waiver signature is obtained. The waiver is a legally binding document that limits our liability for certain risks associated with equipment handling.

5. Cancellation and Refund Policy

5.1 Cancellation by User

You may cancel a scheduled service through the dashboard:

• More than 48 hours before service: Full refund will be processed
• 24-48 hours before service: 50% refund will be processed
• Less than 24 hours before service: No refund, but service may be rescheduled (subject to availability)
• Cancellation requests must be submitted through the dashboard or by contacting support
• Refunds will be processed to the original payment method within 5-10 business days

5.2 Cancellation by Company

We reserve the right to cancel or reschedule services due to:

• Weather conditions that make service unsafe or impractical
• Equipment unavailability or operational issues
• Safety concerns or regulatory compliance issues
• Force majeure events beyond our control

In the event of cancellation by us, you will receive a full refund or the option to reschedule at no additional charge.

5.3 No-Show Policy

If you are not available at the scheduled service time and location, and we are unable to complete the service, no refund will be provided. You may reschedule for an additional fee, subject to availability.

6. Service Limitations and Disclaimers

6.1 Service Availability

We strive to provide reliable service, but we do not guarantee:

• Uninterrupted or error-free access to the Service
• That the Service will meet your specific requirements
• That all features will be available at all times
• That the Service will be free from viruses or other harmful components

6.2 Equipment Condition

While we perform inspection and cleaning services with care and in accordance with industry standards, we are not responsible for:

• Pre-existing damage to equipment that was not disclosed at the time of service scheduling
• Equipment that is beyond repair or cleaning due to age, wear, or damage
• Equipment that does not meet current safety standards or regulations
• Consequential damages resulting from equipment failure after service

6.3 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL UNITED FALL PROTECTION, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

8. Indemnification

You agree to defend, indemnify, and hold harmless United Fall Protection and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party right, including without limitation any right of privacy or intellectual property
• Your violation of any applicable law, rule, or regulation
• Any content or information you submit, post, or transmit through the Service
• Your equipment or property that is the subject of our services

9. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by United Fall Protection and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of the Service
• Use our trademarks, logos, or other proprietary information without our written consent
• Remove any copyright or other proprietary notices from the Service
• Use the Service for any commercial purpose without our express written permission

10. Account Termination

10.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in your dashboard settings
• Contacting us at support@fallpros.net

Upon termination, your right to use the Service will immediately cease. However, we may retain certain information as required by law or for legitimate business purposes.

10.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms
• You engage in fraudulent, abusive, or illegal activity
• You fail to pay amounts due
• We are required to do so by law
• You pose a security risk to the Service or other users

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which United Fall Protection operates, without regard to its conflict of law provisions.

11.2 Dispute Resolution Process

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service, the parties agree to first attempt to resolve the dispute through good faith negotiation. If the dispute cannot be resolved through negotiation, the parties agree to submit the dispute to binding arbitration in accordance with the rules of a recognized arbitration organization, except where prohibited by law.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending an email notification to registered users (for significant changes)

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service and may terminate your account.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and United Fall Protection regarding the use of the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, relating to the subject matter hereof.
